Somali militants

I want to talk today about yet another controversy that is building under the current administration. It seems a few months ago, a Somali soldier/militant was arrested in the war zone by our military according to Military law. Now it appears our President and his administration have confused this “enemy combatant” with an American citizen, and have brought him to NYC for a civilian trial claiming he was not “Mirandized.” I’m sorry! So now every citizen of the world falls under the same legal protection as an American citizen???

I AM NOT A LAWYER, so please don’t hold me to legal details here, but I have a serious problem with this line of thinking. He was captured BY THE MILITARY, in a WAR ZONE, and therefore falls under the rules of the Geneva Convention … which to my knowledge, does not include Miranda rights. Miranda right center on two things: the right to legal representation and the right to remain silent.

So Obama brings this guy to NYC to be tried in a civilian court? What does the average American citizen know of “war zone” mentality and conduct?

“President Barack Obama’s administration has come under fire by Republicans, and even some fellow Democrats, over his decision to prosecute some terrorism suspects in criminal courts and not in military courts, where rules for evidence are looser.

“In Washington, another senior administration official said Obama’s national security team had unanimously recommended the prosecution of Warsame in a criminal court.

“After his interrogation, a fresh FBI team came in and was permitted to talk with Warsame, at which time he waived his legal rights and continued to talk for several days, an official, who wished to remain anonymous, told the Reuters news agency.”

“On Wednesday, Senate Republican leader Mitch McConnell called Ahmed Abdulkadir Warsame a “foreign enemy combatant” and said he should be treated as one. McConnell said Warsame should have been sent to the U.S. military prison at Guantanamo Bay, Cuba, and should be facing trial before a military commission.”

I want to draw a comparison here – a corollary between the “injustice” of the Casey Anthony trial and the proposed trial of this Somali militant.

1. CITIZENSHIP:

Casey Anthony, whatever else she may be, is an American citizen, while

Mr.AHMED ABDULKADIR WARSAME is not. In fact, “Ahmed Abdulkadir Warsame, who has ties to the Al Qaeda-linked group al-Shabaab, was captured April 19 in the Horn of Africa region, possibly in Yemen.”

2. LEGAL RIGHTS:

Anthony was read her legal rights as an American citizen.

Mr. Ahmed Abdulkadir Warsame, as a Somali militant, was questioned legally under Military law. Since when do foreign nationals win the right to be tried as American citizens?

3. POTENTIAL DANGER:

While I believe Anthony is guilty, the prosecution failed to prove their case. They brought little evidence to back their accusation, so the jury was right in finding her “not guilty.” I wouldn’t ask her to babysit my kids, however! I believe she poses a threat, albeit a neighborhood variety.

Mr. Ahmed Abdulkadir Warsame, on the other hand, without a doubt poses a National Security risk. Suppose he is acquitted by a liberal NYC civilian jury with little understanding of military law, and he is freed on the streets of NYC with his friends?

4. CRIMES:

Anthony was convicted “of lying to interrogators.”

Mr. Ahmed Abdulkadir Warsame “was indicted on nine charges, including providing material support to al-Shabab and al-Qaida in the Arabian Peninsula. He also was said to have brokered a weapons deal with the al-Qaida branch in Yemen on behalf of al-Shabab.”

I don’t know. I’m NOT a legal professional! Maybe that’s why it seems so clear to me, eh?

“The chairman of the House Armed Services Committee, Republican Representative Buck McKeon of California said the transfer “directly contradicts congressional intent and the will of the American people.” EXACTLY!
